Stephens County District Attorney Dee Peavy’s office recently released the following list of plea deals that were made in the 90th Judicial District Court.

February 2020

  • David Emery Hoffine, 34, Breckenridge, pleaded guilty to the offense of Aggravated Sexual Assault of a Child – Lesser Included Offense and was sentenced to 35 years confinement in Texas Department of Criminal Justice – Institutional Division (TDCJ-ID), and to pay $5,000 fine and court costs; and, he pleaded guilty to the offense of Aggravated Sexual Assault of Child – Lesser Included Offense and was sentenced to 35 years confinement in TDCJ-ID, and to pay $5,000 fine and court costs.
  • Richard Medina Perez, 65, Breckenridge, pleaded guilty to the offense of Possession of Controlled Substance Four Grams or More but Less Than 200 Grams – Methamphetamine and was sentenced to 35 years confinement in TDCJ-ID, and to pay $1,000 fine, restitution, and court costs.
  • Jesse Guerrero, Jr., 30, Breckenridge, pleaded guilty to the offense of Continuous Violence Against the Family and was sentenced to 10 years community supervision, and to pay $750 fine and court costs.
  • Andrew Charles Yates, 32, Fort Worth, pleaded guilty to the offense of Engage in Organized Criminal Activity and was sentenced to eight years community supervision, and to pay $3,000 fine, restitution, and court costs.
  • Johnathan Robert Wimberley, 44, Breckenridge, pleaded guilty to the offense of Engage in Organized Criminal Activity and was sentenced to four years community supervision, and to pay $3,000 fine and court costs.

March 2020

  • Eric Shane Gill, 38, Breckenridge, pleaded guilty to the offense of Prohibited Weapon – Firearm Silencer and was sentenced to 10 years community supervision, and to pay $1,000 fine and court costs; and he pleaded guilty to the offense of Take Certain Wildlife Resources without Consent and was sentenced to five years community supervision, and to pay restitution and court costs.
  • Austin Rayce McDonald, 26, Breckenridge, pleaded guilty to the offense of Possession of Controlled Substance with Intent to Deliver Four Grams or More but Less Than 200 Grams – Methamphetamine and was sentenced to 10 years community supervision, and to pay $1,500 fine, restitution, and court costs.
  • Francisco Javier Jaramillo, 47, Breckenridge, pleaded guilty to the offense of Assault Family/Household Member with Previous Conviction and was sentenced to five years community supervision, and to pay $1,000 fine and court costs.
  • Andres Perales, Jr., 54, Breckenridge, pleaded guilty to the offense of Credit Card or Debit Card Abuse and was sentenced to five years community supervision, and to pay $500 fine, restitution, and court costs.
  • Elizabeth Pauline Wheeler, 21, Breckenridge, pleaded guilty to the offense of Possession of Controlled Substance with Intent to Deliver Four Grams or More but Less Than 200 Grams – Cocaine and was sentenced to five years community supervision, and to pay $500 fine and court costs.
  •  Shane Allen Anthony, 41, Breckenridge, pleaded guilty to the offense of Assault Causes Bodily Injury Family Violence – Lesser Included Offense and was sentenced to two years community supervision, and to pay $500 fine and court costs.
